Arrest warrants have been issued for president and chief financial officer of a now-defunct Plymouth company. Stone Creek Homes, Inc. President and Chief Executive Officer David A. Ferguson and Chief Financial Officer Alan G. Donohue are each charged with numerous felony offenses in Marshall Superior Court.
Court documents released today by Marshall County Prosecuting Attorney David R. Holmes allege Ferguson stole from employees and committed other racketeering violations between Feb. 13 and June 1, 2012. Charges contained in a 14 count indictment include three counts of theft, receiving stolen property, conspiracy to receive stolen property, six more theft charges and three counts of corrupt business influence. Donohue faces 11 felony counts, including aiding in the commission of theft, conspiracy to commit receiving stolen property, six counts of theft and three counts of corrupt business influence.
Stone Creek Homes shut down in late May of 2012, laying off employees in Indiana and Nebraska without warning. The company operated for less than a year in the former Shamrock Homes facility in Plymouth. Holmes convened a grand jury in January of this year to hear evidence against Ferguson and Donohue gathered by investigators from his office and the Indiana State Police. The panel handed down the indictments on Feb. 20, but they were sealed until last Friday. Warrants were also issued then for Ferguson and Donohue’s arrest. As of this morning, neither man had been apprehended. Court documents indicate Ferguson owns homes in Madison, Miss. and Snyder, Texas. Donohue lives in Macon, Ga. according to a news release from the Marshall County Prosecutor’s Office. Bond for both men is set at $15,000 cash.
