Indiana Court of Appeals Upholds Starke Circuit Court Sentence

 The Indiana Court of Appeals upheld a sentence imposed against Dennis Wireman in Starke Circuit Court.

Wireman was convicted in 2013 on three counts of illegal possession of a controlled substance as a Class D felony in two separate cases, plus a Class D felony charges of illegal possession of a syringe and operating a vehicle while intoxicated with a prior conviction.

Judge Kim Hall sentenced Wireman to five years in the Indiana Department of Corrections. Wireman filed an appeal stating that the sentence was inappropriately harsh.

The Indiana Court of Appeals returned a decision stating that the nature of Wireman’s offenses justifies his sentence. In two separate incidents, Wireman was found passed out inside a vehicle while in the driver’s seat, one with the vehicle still in gear, according to court documents. When the Court of Appeals looked into his character, he was found to be reckless in nature, a substance abuser and did not make it a point to seek help. His extensive criminal history also did not work in his favor.

It was the decision of the Court of Appeals that Wireman could not establish that his sentence was inappropriate and the judgment of the trial court is affirmed.
